April 2010

Times are a-changing …….

Sadly – on the one hand - the CTFA will be saying farewell to Pam Dillon as she relocates to the fairest Cape at the end of March this year.  Pam and her family will be taking up residence in Cape Town and she will be joining her husband in a new exciting business venture.

Looking back over the past 5 years, Pam, in her position as Executive Director for the CTFA, together with her team, has achieved many beneficial and noteworthy milestones for the members and the industry at large.  Pam will be sorely missed by the members, associates, colleagues and friends.  As you broaden your horizons Pam, we wish you and your family well in your new endeavours and may all your efforts be a great success.

On the other hand – the CTFA welcomes Sally Gnodde who will take over the reins as Executive Director.  Sally brings with her  valuable knowledge and experience acquired during her career in the cosmetic industry with market leading companies like  Estee Lauder, Revlon, l’Oreal, Amka and Avroy Shlain.  Accustomed to working to incredibly high standards, Sally accepted this challenge for not only the portfolio of unwavering attention to Standards and Regulatory issues but also – importantly - with the interests of the cosmetic industry at heart.

Talking to Sally generally about the CTFA, she said “No-one else in the industry can provide the technical offerings and associated benefits that the CTFA can provide. For example, the regularly updated, integrated information in the regulatory environment covers guidance on legalities, notifications, ingredient restrictions, packaging and labelling requirements, microbiological limits and safety of cosmetic products and more. I am aware that the overhauled Compendium is about to be launched – offering updates and so much more depth in terms of content and usability. “

Continuing the conversation, Sally commented “Since inception, with the more recent support of Government bodies, the Department of Trade and Industry plus the powers that be within the cosmetic, toiletry and fragrance industry, the CTFA is well positioned as the recognised supplier of regulatory standards and technical support.  That’s a very exciting position in which to be, because no other organisation can offer what the CTFA can. That’s what made it such an exciting opportunity to pursue.  It’s my time to give back to the cosmetic industry and I look forward to being of service to the cosmetic industry once again”.

Please join us in welcoming Sally by your continued support to the CTFA as you have done in the past.

 Cosmoprof

It’s that time of the year …… Cosmoprof, Italy, known as the Biggest International Cosmetic Exhibition

For more than 40 years the Cosmoprof Exhibition has been supported by exhibitors of market leading brands, new entrepreneurial companies, suppliers, manufacturers and literally millions of interested visitors allied to the cosmetic industry. Most sought after are the high impact events, conferences, and workshops. The most recent development for the Bologna venue is a specific product area dedicating focus to the Spa industry.

For 2010, the CTFA managed a mini South African pavilion for its participating Members at Cosmoprof for the period 16th-19th April.  This activity was supported and promoted by the dti (Department of Trade and Industry) under the EMIA Individual Assistance Scheme.  The main objectives were to showcase the South African Cosmetic Industry abroad and facilitate the export opportunities for the South African Cosmetic Industry.

Annually, the CTFA actively furnishes international assistance to conforming Members who wish to participate at Cosmoprof.  The CTFA provides support in the form of information and services structured to optimise their business opportunities and logistics for shipping marketing material and displays to the venue in Italy.

Packing for Italy were the following dynamic South African companies, looking to expand their trading horizons internationally:-

Lilian Terry International, i-Slices Manufacturing, The House of Aloes and Ladine (Pty) Ltd.

The CTFA managed a stand on the pavilion to promote the South African Member companies – opening contact opportunities of networking, information communication and will furnish the 2010 CTFA Member Directory to interested visiting parties.

Reporting back; every day was a successful day for our exhibiting CTFA delegates with interested visitors and potential overseas distributors.

Absent Members were represented at Cosmoprof by the CTFA incoming and outgoing Executive Directors, Sally Gnodde and Pam Dillon respectively.

Interested visitors to the pavilion received the CTFA 2010 South African Cosmetic Exporters Directory   featuring the CTFA Members with contact and business details for easy reference.

 Imports & Exports

Good News and assistance for our Members importing or exporting products……

Have you experienced unforeseen delays when importing goods through Port Health at O.R. Tambo Airport?    Help is at hand for our Members who meet all the existing Codes of Practice and Standards as laid out in the CTFA Cosmetic Compendium.  This includes stringent adherence to ingredient content requirements that are allowed to be used as well as qualifying Good Manufacturing Procedures.

The CTFA   can assist and alleviate certain problems by issuing a Certificate of Cosmetic Conformity for the itemised products of the incoming shipment.  This can be submitted to Port Health Authorities together with all other customs documentation for clearance purposes.  This documentation has assisted some Members to date in minimising delays caused by inspections and other lengthy processes.

In addition, for our exporting Members the CTFA issues Certificates of Free Sale for products being exported.

Invitation from the Embassy of France in South Africa

The CTFA was invited by the French Embassy’s Department of Economic Affairs to their event “French buyers’ day with Edcon” held at their Sandton offices on 23rd March.   The CTFA was represented by Sally Gnodde, incoming Executive Director and Jill Gardiner, Technical Director and were hosted by M. Xavier Chatte-Rouls, Head of the Department, Consumer Goods and Health Care along with Tatiana Miron, Trade Associate, Consumer Goods, Beauty Products and Healthcare. The purpose being to assist with expanding French business internationally and to promote business relations between France and South Africa.

Jill Gardiner presented the roles and responsibilities of the CTFA with regard to consumer goods in the beauty products’ category giving the attendees an insight to the policies and procedures for not only local production but also importing and ultimately marketing cosmetics, toiletries and fragrances within the South African Regulatory System. Sally Gnodde made mention of the imminent Consumer Protection Act and the importance thereof going forward.

Consumer Protection Act

High on everyone’s  Agenda –  and going forward – The Consumer Protection Act

The Consumer Protection Act 68 of 2008 was signed into law on the 24th April 2009. The Act will come into force on the 24th April 2010 when the Strict Liability Clause comes into effect. Regulations will be in place by the 24th October 2010.

The Department of Trade & Industry’s National Consumer Commission/Tribunal, which will oversee compliance and enforcement, has already been formed, so government is ready.  The industry needs to be ready as well. The Act has approximately 120 sections which will be applicable to all industries in different ways.

In a consumer driven industry, the cosmetic, toiletry and fragrance industry, needs to be thoroughly aware of the Act – ready and prepared.  It will be prudent for companies to put measures in place as soon as possible for compliance as the Act will have wide-reaching impact on South African business as we know it. All companies could be affected by the Act, whether you are a small emerging company or a large multi-national corporation.

The purpose of this Act is to promote and advance the social and economic welfare of consumers in South Africa by establishing a legal framework for the achievement and maintenance of a consumer market that is fair, accessible, efficient, sustainable and responsible for the benefit of consumers generally.

The Act targets previously disadvantaged persons. In short, The Act promotes that every consumer has a right to safe, good quality products.

From time to time, we may be in a position to provide further updates on the Consumer Protection Act, in which case, these will be featured in our Newsletter.

Advocate N.J. Melville has recently published a book entitled “THE CONSUMER PROTECTION ACT made easy”  The book gives clear guidelines on understanding the Act, how to protect your business and knowing your obligations.  Negotiations are underway with Adv. Melville to present as a guest speaker at our imminent Business Seminar and to have the book available for purchase at a special discounted price of R150.00 for attendees.
